ZVEI Recommendations on Chapter VI Data Act - Clarifying the Scope of Data Processing Services

Europe’s digital transformation offers huge opportunities, but the current Data Act risks undermining them. Chapter VI on “Switching between data processing services” raises key questions: What exactly counts as a data processing service? And how are SaaS and PaaS offerings affected? ZVEI therefore calls to exclude Software-as-a-Service (SaaS) and Platform-as-a-Service (PaaS) from the obligations under this chapter. For manufacturers expanding their products with digital services, smooth switching is crucial to foster innovation and flexibility.
